Rules of the “Fairphone” Giveaway
Article 1: Organiser
The company UNDO SRL, whose registered office is located at 1170 Brussels, chaussée de La Hulpe 177/11, registered with the Carrefour Bank of Enterprises under number 0788.352.652 (hereinafter referred to as the “Organising Company”) is organizing from 10 November 2025 to 31 December 2025 a referral game entitled “Fairphone Giveaway 2025” (hereinafter referred to as the “Game”) in Belgium.

Participation in the Game implies express acceptance of these rules, without any reservations or preconditions, and failure to comply with these rules will automatically result in the Participant’s participation being declared null and void, as well as the loss of the prize, if applicable.
These rules are communicated to UNDO’s clients via Email with a referral link to UNDO’s web portal.
Article 2: Conditions relating to Participants
This Game is only open to natural persons of majority age (as evidenced by their civil status) residing in Belgium (hereinafter the “Participant” or collectively the “Participants”), with the exception of the staff of the Organising Company and their direct family members and, in general, of any person who has been directly or indirectly involved in the design, implementation and/or management of the Game.
Article 3: Duration
The Game starts on 10 November 2025 and ends on 31 December 2025 included.
The Organising Company reserves the right at any time and without prior notice to extend, suspend or interrupt this Game if circumstances so require.
The Organising Company cannot be held responsible for this.
Wherever possible, such modifications or changes shall be notified in advance by all appropriate means.
Article 4: Terms and conditions of participation
To play and participate validly, the Participant must:
- Be a UNDO customer with an active subscription and participant of the referral (MGM) program
- Have friends and/or family members become an UNDO customer (active subscription) by using the personal referral link of the Participant via Viral Loop
The winners will be the 2 people who have registered the most successful referrals via “Viral Loop” by ensuring that by sharing their personal referral link, people who use this shared link will also become an active UNDO customer.
Successful referrals are counted by Viral Loop and the Participant agrees that the results are binding.
In the event of a tie, a draw will be held to determine the winners.
Only one winner per household (same name, same postal address) will be eligible to win the prize for the entire duration of the Game.
Any costs incurred in participating in the Game will not be refunded.
Article 5: Prizes
The prize to be won per Participant is:
- 2 Fairphone 4 5G 128GB
The winners of a prize will be notified by email by the Organising Company within 5 calendar days following the closure of the Game.
Winners agree to provide accurate and up-to-date information.
At all times, they are responsible for the accuracy of the information they communicate. The Organising Company may not be held liable in any way if it fails to contact a winner to inform him/her of his/her win and/or if the prize is lost due to an incorrect or obsolete address.
The prizes offered may not give rise to any dispute as to their nature or their amount. Under no circumstances may the value of these prizes be requested in cash or in any other form.
If circumstances so require, the Organising Company reserves the right to replace a prize with any other prize of equivalent value. In this case, the winners will not be entitled to any compensation of any kind other than the newly determined prize. No equivalent value of the prizes in question will be offered as compensation.
The Organising Company will not provide any service or guarantee other than the delivery of the prizes as described in the Rules and declines all responsibility for any incident, accident and/or damage that may occur during the use of the prizes.
The Organising Company may not be held liable for the quality of the prize in relation to that announced or expected by the Participant, for the manner in which it is awarded or for any damage of any kind (physical, moral, material, etc.) that the winner or any other person may suffer or cause.
Any recourse by the Participant or a third party may only be directed against the manufacturer of the product constituting the prize.
Article 6: Fraudulent use of these rules
The Organising Company undertakes to make its best efforts to ensure that equal treatment is given to all Participants. Any fraud or attempted fraud against these rules will result in the invalidity of the fraudster’s participation as well as the loss of his/her prize, if applicable.
Thus, the Organising Company may suspend and cancel the participation of one or more Participants in the event of the observation of suspicious or fraudulent behaviour in an attempt to obtain one or more prizes. The Organising Company shall be the sole arbiter of the exclusion or reinstatement of the Participants concerned in light of the information in its possession.
In the event of a claim, Participants must prove that they have behaved in accordance with these rules. The Organising Company shall not be held liable in this respect. The Organising Company may cancel all or part of the Game if it appears that fraud has occurred in any form whatsoever, in particular in a computerised manner.
The Organising Company reserves the right to prosecute offenders of these rules by any means, including legal action.
Article 7: Responsibilities
7.1 Endowments
The Organising Company assumes no responsibility for the condition of the prizes.
In the event that the prize is defective, winners are invited to make their claims directly to the manufacturer of their prize.
7.2 Modification of the Game
The Organising Company may not be held responsible if, for reasons of force majeure beyond its control, this Game is partially or totally modified, shortened, postponed or cancelled, even without prior notice, if the circumstances so require. Insofar as possible, these modifications or changes will be the subject of prior information by all appropriate means.
Article 8: Right of withdrawal
In accordance with article VI.46 of the Code de Economic Law, the Participants are entitled to withdraw from this contract, without justification, within 14 days of participation. The Participant can notify his intention to withdraw using the form available at https://undo.be/docs/fr/UNDO_Model_withdrawal_form.pdf or by e-mail, regular mail or registered mail.
However, if the contract is already executed before the expiration of the 14-day period, the Participant recognizes that he loses the right to withdraw.
Article 9: Personal data
The Participants authorise all useful verifications concerning their personal data.
Any false declaration, indication of false identity or address will result in the immediate elimination of the said Participant and, where applicable, the reimbursement of the Prize already withdrawn.
The Winners accept that their names, photos or any report on the Game or its results may be used for advertising or editorial purposes by the Organising Company, without them being able to claim any remuneration for this.
Personal data necessary for the execution of the Game will be processed. To participate in the Game, you must provide the following information (hereinafter “the Data”):
- Name
- First name
- Adresse e-mail
- Postal address (street number, postal code, city, country), only for winners who will be contacted by email by UNDO
The Data of the Participants are collected for the purpose of participating in the Game described in these Rules and will be kept for this purpose for the duration of the Game plus 6 months to cover the period for receiving the prize. Nevertheless, the Data may be kept before deletion, in intermediate archives, for the duration of the legal statute of limitations in order to preserve proof of your participation, of the sending of the prizes or of your consents for the defence of the Organising Company’s rights. This data may be processed on paper or by automated processing. This information is intended for the Organising Company acting as the data controller, for the companies in its group, and for its subcontractors.
In accordance with the applicable law and the European Regulation on the protection of personal data in force since 25 May 2018, Participants have a right of access, rectification, withdrawal, partial or complete deletion, concerning the personal data that concern them that they can exercise by simple written request addressed to:

Finally, Participants have the right to lodge a complaint with the competent authority, namely :

Article 10: Availability of the Rules

Article 11: Settlement of disputes – Applicable law – Claims
Any difficulty in interpreting or applying these Rules shall be decided by the Organising Company in accordance with Belgian law. Any behaviour by a Participant that may be detrimental to the image of the Organising Company and/or contrary to public order and/or morality may result in the invalidation of the participation of said Participant in the Game. The Organising Company may, as of right and without prior notice, exclude any Participant who has not complied with these Rules, and proceed with the pure and simple cancellation of any Prize to which said Participant may be entitled.
Should any of the clauses of these Rules be rendered null and void by a change in legislation/regulation or by a court decision, this shall in no way affect the validity of and compliance with the other clauses of these Rules.
These rules are subject to Belgian law.
No requests (written, oral or otherwise) concerning the interpretation or application of these rules, the terms and/or mechanics of the game and the determination of the winners will be answered.
In the event of a dispute or claim, for any reason whatsoever, requests must be sent within a maximum of 7 days after the end of the game (as evidenced by the postmark), under penalty of foreclosure, to the UNDO Customer service department:

All disputes arising from these rules which cannot be resolved amicably shall be submitted to the jurisdiction of the courts of Brussels.
